1. Acceptance of Terms
By accessing or using the FullStackRx platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
2. Description of Service
FullStackRx provides a cloud-based pharmacy management platform designed for compounding pharmacies, including prescription management, provider portals, patient management, payment processing, and refill automation.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating an account and promptly update any changes.
4. Acceptable Use
You agree not to: • Use the Service for any unlawful purpose • Attempt to gain unauthorized access to any part of the Service • Interfere with or disrupt the integrity or performance of the Service • Upload or transmit viruses or malicious code • Reproduce, duplicate, copy, sell, or resell any portion of the Service
5. Payment Terms
Certain features of the Service require payment. You agree to pay all fees associated with your use of the Service. All fees are non-refundable unless otherwise stated. Payment processing is handled through Authorize.net, and you agree to their terms of service as well.
5.5 SMS/Text Messaging
SMS/Text Messaging. The Service may send transactional text messages to patients on behalf of healthcare providers using the platform. These messages include: (1) patient registration invitations containing a secure link to create an account, and (2) prescription payment reminders. Messages are initiated by a licensed healthcare provider through the platform when creating a patient invitation or when a prescription requires payment. Message frequency is typically 1-3 messages per patient interaction. Message and data rates may apply. Patients may opt out of future text messages at any time by replying STOP to any message. Opting out of SMS does not affect access to the platform — email notifications are available as an alternative channel for invitations. Payment reminder messages will cease upon opt-out. 6. Intellectual Property
The Service and its original content, features, and functionality are owned by FullStackRx and are protected by international copyright, trademark, patent, and other intellectual property laws.
7. HIPAA Compliance
FullStackRx is designed to be HIPAA-compliant. If you are a covered entity or business associate under HIPAA, you may be required to enter into a Business Associate Agreement (BAA) with us prior to using certain features of the Service.
8. Limitation of Liability
To the maximum extent permitted by law, FullStackRx shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, or goodwill.
9. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service. Your continued use of the Service after changes constitutes acceptance.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
